This Privacy Policy describes how Over the Fence ("we," "us," or "our") collects, uses, and shares your personal information when you visit or make a purchase from overthefencehome.com (the "Site"), shop with us in our store, or sign up to receive text messages from us. It also includes the terms of our SMS text messaging program.

Personal information we collect

When you visit the Site, we automatically collect certain information about your device. This includes information about your web browser, IP address, time zone, and some of the cookies installed on your device. As you browse the Site, we also collect information about the individual web pages or products you view, what websites or search terms referred you to the Site, and how you interact with the Site. We refer to this automatically collected information as "Device Information."

We collect Device Information using the following technologies:

This includes your name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number. We refer to this information as "Order Information."

When you sign up for our text messages, whether online, at checkout, or in our store, we collect your mobile phone number and a record of your consent to receive messages. We refer to this information as "Mobile Information."

When we refer to "Personal Information" in this Privacy Policy, we mean Device Information, Order Information, and Mobile Information.

How we use your personal information

We generally use Order Information to fulfill orders placed through the Site. This includes processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations. We also use Order Information to:

• Screen our orders for potential risk or fraud; and
• Provide you with information or advertising about our products or services, when this matches the preferences you have shared with us.

We use Device Information to help us screen for potential risk and fraud (in particular, your IP address). We also use it more generally to improve and optimize our Site, for example by generating analytics about how customers browse and interact with the Site and by assessing the success of our marketing and advertising campaigns.

We use Mobile Information only to send you the text messages you have agreed to receive and to manage your subscription, as described in the SMS Terms below.

Sharing your personal information

We share your Personal Information with third parties that help us use it as described above. For example, we use Shopify to power our online store. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. Information may be shared with subcontractors that help us deliver our messaging services, such as messaging platform providers and phone companies. These subcontractors may use the information only to provide those services.

We may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant, or other lawful request for information we receive, or to otherwise protect our rights.

Behavioral advertising

As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may interest you. Do not track

Please note that we do not alter our Site's data collection and use practices when we see a Do Not Track signal from your browser.

SMS / Text Messaging Terms

Program description. By opting in to receive text messages from Over the Fence, you agree to receive recurring promotional and informational messages at the mobile number you provided. These may include sales, events, new arrivals, order and special-order updates, and store announcements. Consent to receive text messages is not a condition of any purchase.

How to opt in. You can sign up by checking the text message consent box on our Site or at checkout, or by asking a member of our staff to add you in our store. After you sign up, you will receive a confirmation message.

Message frequency. Message frequency varies.

Costs. Message and data rates may apply. Contact your wireless carrier for details about your plan.

Opting out. You can cancel at any time by replying STOP to any message from us. You will receive one final message confirming that you have been unsubscribed. After that, you will not receive further messages unless you opt in again by replying START.

Carrier liability. Wireless carriers are not liable for delayed or undelivered messages.

Privacy. Your Mobile Information is handled as described in this Privacy Policy. We do not sell or share your mobile number or text messaging consent with third parties for their marketing purposes.

Your rights

If you are a European resident, you have the right to access the personal information we hold about you and to ask that it be corrected, updated, or deleted. To exercise this right, please contact us using the contact information below.

If you are a European resident, please also note that we process your information to fulfill contracts we may have with you (for example, if you make an order through the Site) or to pursue the legitimate business interests listed above. Your information will be transferred outside of Europe, including to Canada and the United States.

Data retention

When you place an order through the Site, we will keep your Order Information for our records unless and until you ask us to delete it. We keep Mobile Information and records of your text message consent for as long as you are subscribed, and afterward as needed to honor your opt-out and to meet legal requirements.

Changes

We may update this Privacy Policy from time to time. For example, we may do so to reflect changes to our practices or for other operational, legal, or regulatory reasons.
